Contractual Partners, Language and Conclusion of Contract

Neither the display of goods on our website nor the sending of products to customers via email etc. is an offer for sale (in the legal sense) but an invitation for you to make an offer in relation thereto. All contracts entered into using our website are made directly between the customer and SIM Management Services s.r.o. (the parent legal entity of Susanne Simonis Interiors) further referred to as “SIMMS”.

Description of Products

Each product purchased is sold subject to its Product Description. We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on our website are correct at the time when the relevant information was entered onto the system. Although we aim to keep our website as up to date as possible, the information, including Product Descriptions, appearing on our website at a particular time may not always reflect the position at the exact moment you place an order.

-> Measurements

The dimensions given are written for your guidance. Before ordering, please ensure that there is adequate room to take the furniture through any doorways and windows, taking note of any restricted passageways, stairs and awkward turns. Please refer to our access guidelines for further information.

-> Wood

With exposure to light and air wood will mature and as part of this process may change the colour. For this reason, objects placed on the surfaces could leave ‘shadows’ when removed. Should this happen, exposure to daylight will eventually darken these paler areas. SIMMS will not be liable for wrong use of our products, or for improper use of cleaning detergents for cleaning of our products.

-> Fabrics

Most of our fabrics are made from natural product and each will have its own individual characteristics and natural marks. Differences in the grain, texture and colour may be apparent from one hide to another and even within the same hide. SIMMS selects only fabrics of the highest quality, but some marking is inevitable and should be accepted as part of the individual appearance of the furniture. SIMMS will not be liable for wrong use of our products, or for improper use of cleaning detergents for cleaning of our products.

Entering Contract

By submitting an order by clicking “order” you make a contractual offer to us in respect of such goods, which we are free to accept or reject. After submitting your order, you will receive a confirmation e-mail from an e-mail address: shop@susannesimonisinteriors.com. You will receive a second e-mail from the same address on the dispatch. Please note that e-mails from any other e-mail address cannot, for the purposes of the contract, be considered as a formal confirmation of the order or of the dispatch.

Order acceptance and the completion of the contract between you and SIMMS will take place on the dispatch of the products ordered by you, unless we have notified you that we do not accept your order or you have cancelled it in accordance with the instructions below in “Contract Cancellation” section.

Non-acceptance of an order or cancellation from our side may be a result of one of the following:

  • The product you ordered is unavailable from stock.
  • The payment authorization was unsuccessful.
  • There was an error in identification of the price or the product in your order.
  • The order criteria set out in the Terms & Conditions were not met.

If there are any problems with your order, you will be contacted by the Susanne Simonis Interiors representative. On the point of the order, SIMMS will take full payment in advance of the delivery. For our cancellation and refund policy please see section “Contract Cancellation”.

We reserve the right to reject any offer to purchase by you at any time until the commencement of shipment. We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure in line with our data protection and Privacy Policy.

Contract Cancellation & Refunds

You are entitled to cancel your contract if you wish to do so, anytime after you make the order up until 7 days after the day on which you receive your delivery. To exercise your right of cancellation you must give notice per email using the following e-mail address (shop@susannesimonisinteriors.com) with full details of your order.  We kindly also ask you to provide us with the reason for your cancellation. Especially, if the cancellation is due to the damage of the goods received, you must specifically note this reason with a short description of the damage observed in your cancellation notification. Otherwise we will assume that your cancellation involves good quality products, which must be returned in perfect conditions back to us. Cancellation notifications by telephone are not accepted.

We will refund in full payments made on the orders if cancelled before the dispatch, including the prepaid shipping costs. If you exercise your right of cancellation after the items have been dispatched to you, you will be responsible for returning your order to SIMMS at your own cost within 10 days from the cancellation notice.

-> Returns of Good Products

You must take reasonable care to ensure the items are not damaged in the meantime or whilst in transit. SIMMS reserve the right to refuse a refund on the item or deduct portion of the original selling price from the refund amount if we find that the product has not been returned to us in fully re-sellable condition. The goods returned must be in a perfect and saleable condition with original product packaging and instructions where appropriate. If the goods do not reach us in a perfect and saleable condition, and in their original packaging, then your right to a full refund may be affected. Otherwise your payment will be returned in full including the delivery cost within 14 days from your cancellation notice using the same payment method used to purchase the product. Note that you will be responsible for the cost of returning the product.

-> Return of Damaged or Short Delivered Products

We strongly advise you to thoroughly check your goods upon receipt. To protect your interests, any claim concerning short delivery and/or damaged and/or defective goods found on delivery or shortly after must be notified as soon as possible, but latest within 7 days of the delivery per e-mail at shop@susannesimonisinteriors.com. We do not accept any claims for damage caused by you, the customer.  You will be asked to provide a proof of damage and to return the goods back to us within 10 days of the cancellation notice. Note that you will be responsible for the cost of returning the product.  Upon receipt of goods we will return full payments made on the order.

Products Excluded from Cancellations & Refunds

Products that fall into the following categories cannot be cancelled or refunded unless they are proven to be faulty:

  • Goods which are made to order, made to a customer’s own specifications, made to measure or personalized items.
  • Self-assembly furniture cannot be returned once assembly is part or fully completed.

Refusal of Transaction

We reserve the right to withdraw any products from our website at any time and/or remove or edit any materials or content on our website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product from our website whether or not that product has been sold, removing or editing any materials or content on our website, refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

To be eligible to purchase products on our website and lawfully enter into and form contracts on our website under EU law you must:

  • Register by providing your real name, phone number, email address, payment details and other requested information.
  • Be over 18 years of age.
  • Stipulate a delivery address in the EU validated by our customer service team. (PO box and hotel addresses are not acceptable).
  • Possess a valid credit card issued by a bank acceptable to us or have a valid PayPal account.

By making an offer to buy a product, you specifically authorise us to transmit information (including any updated information) or to obtain information about you from third parties from time to time, including but not limited to, your credit card number or credit reports, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions. Payment

All prices are inclusive of VAT (where applicable) at the current rates and are correct at the time of entering the information onto the system. The total cost of your order is the price of the products ordered plus delivery. You confirm that the credit card that is being used is yours. All credit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.

Shipping & Delivery

Delivery will only be made to addresses within the EU unless otherwise arranged with our representative (shop@susannesimonisinteriors.com) prior to placing an order. It is your responsibility to accept delivery at your chosen address.

SIMMS normally ships goods a few weeks after a sale event has ended and once its account has been credited with the full invoice amount. Earlier shipping is not usually possible since the shipping date depends on suppliers and manufacturers. Individual shipping times and any special shipping terms (bulky products) are stated on the product pages.

SIMMS does not assume any sourcing risk and is only obliged to ship from existing stock or from stock ordered from suppliers. SIMMS has no liability to you in the event that its obligations to ship products to you ceases to exist when, SIMMS, through no fault of its own, does not receive goods in full or on time from suppliers, (provided always that SIMMS has informed customers as soon as reasonably practicable of the failure of its supplier and/or and has not explicitly agreed a separate sourcing risk). In such circumstances any payments made by you will be refunded.

In cases of force majeure (as subsequently described), shipping duration may increase within reason. Force majeure shall include strike, exclusion, official intervention, energy (or resource) scarcity, shipping difficulties, business complications such as fire or water damage to machinery, lightning or any other unforeseeable business complications for which SIMMS cannot be held responsible. SIMMS will inform you of the starting (and ending) point of such shipping impediments as soon as reasonably practicable.

SIMMS reserves the right to cancel any contract with you if delivery fails three times through your fault. Payments already made will be refunded. SIMMS reserves the right to charge you for additional costs that it may incur due to failed deliveries. If your goods remain at our warehouse for more than four weeks, during which time you fail to accept delivery/redelivery (despite SIMMS having contacted you to do so), you may incur a storage charge. We also reserve the right to cancel your order and retain portion of your order value.

SIMMS asks you to immediately inform the deliverer/carrier and SIMMS about obvious damage to your order during transit. Doing so has no influence on your rights but will help SIMMS to make its own claims against the supplier of goods to SIMMS or our delivery agent.

Where you have not received your order 14 working days after your dispatch confirmation email, please notify us immediately so we can look into this for you. Failure to notify us within 30 days of your dispatch confirmation email could result in your order being lost.

Our regular delivery terms generally mean delivery to your entrance door. Special delivery requirements may result in extra charges that will need to be paid by the customer, please contact us for further details at shop@susannesimonsinteriors.com.
